• The Borgata Online Borgata Bucks: Summer of Mystery promotion (the promotion) will run from 12:00 am (EST) Wednesday, June 14 – 11:59 pm Wednesday, September 6, 2023 (the promotional period).

Sponsor:

• The sponsor of the promotion is Borgata Online, LLC (the sponsor). Sponsor is located at Harborside Plaza 2, Suite 700, 200 Hudson Street, Jersey City, NJ 07311.

Action Required:

• By taking part in this promotion, you hereby agree to these Borgata Online: Borgata Bucks: Summer of Mystery Terms and Conditions and to our sponsor’s Standard Promotional Terms and Conditions.

How Can I Participate?

• In order to participate in this promotion, an eligible player (a participant) must place an eligible wager (as described below) during the promotional period.

Eligible Participants:

• Borgata Online accounts only.
• Participants must be 21 years of age or older and playing within the state of New Jersey.
• Participants must have made a minimum of one (1) deposit into their Borgata Online account.
• Participants who have previously been excluded from promotions will not be eligible to participate.
• All personal and contact data associated with the participant’s account must be verifiable.

• Employees, officers, directors, members and representatives of Borgata Online, its parent and affiliate companies, and any advertising agency or web company connected with the sponsor (collectively, promotion entities), as well as immediate family members (spouse, parents, siblings and children) and household members of each such person, are not eligible to participate in this promotion. The sponsor reserves the right to verify the eligibility of all participants. Sponsor additionally reserves the right to refuse or otherwise restrict the eligibility of any individual to participate in the promotion for any reason, in its sole discretion, including based on a participant’s wagering patterns or wagering history.
• Additionally, any individual with a Borgata account on any product in one (1) or more jurisdictions where Borgata operates that has been involuntarily closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this promotion even where such entrant may seek entry in this promotion through an active account in another jurisdiction.

Eligible Wager:

• An eligible wager is a wager by the participant in the participant’s Borgata Online account that complies with the following wagering requirements:
• It is a real money wager of at least $0.10 on an eligible game during the promotional period.
• It is placed via the Borgata Online website, or through the mobile app.
• The eligible games for this promotion are indicated on the Borgata Bucks’ promotional page and may change from time to time without notice.

How Does It Work?

• This promotion offers three (3) types of Bonus Jackpots during the promotional period as described below.
• Each Bonus Jackpot will reward a different amount of Bonus Dollars (each, a Bonus Jackpot Value), depending on the mechanics of that Bonus Jackpot.
• Bonus Jackpots shall be triggered as defined below.
• The Bonus Jackpot Values will be displayed on the promotional page.
• Number and amount of prizes will depend on the number of Bonus Jackpots triggered.

How Can I Win?

• Once a Bonus Jackpot is triggered, eligible participants who have placed an eligible wager in the fifteen (15) seconds before the applicable Bonus Jackpot is triggered, shall be eligible to win, as detailed in the Bonus Jackpot Terms section below.
• Eligible participants who have placed an eligible wager are referred to as Qualified Participants.
• Within one (1) minute after a Bonus Jackpot has been triggered, Qualified Participants will be notified if they have won any Bonus Dollars amount, and how much they have won, via a pop-up notification message on the promotional page.
• Qualified Participants may refer to the promotional page at any time during the promotional period, to check if the Bonus Jackpots have been triggered.
• Winnings shall be credited in the form of Bonus Dollars, subject to a 1x wagering requirement, and valid for three (3) days from award to participant’s account. (See the Wagering Requirement section for details.)
• Bonus Dollars are non-transferable and cannot be used on poker or sports.
• Winnings can:
• Be redeemed as instructed via the notification message.
• Be declined as instructed via the notification message.
• If the winnings have been redeemed, they will be credited to winning participants within 24 hours of the winnings being redeemed.
• If the winnings have been declined, the winnings shall not be credited, and the funds shall expire.
• If no selection is made, the winnings shall remain available and redeemable to the winning participant for 48 hours. The winnings can be redeemed in the participant’s account.

Bonus Jackpot Terms:

• Mini Mystery Jackpot
• The Mini Mystery Jackpot can trigger if its value reaches a maximum value of $300.
• Once triggered, one (1) Qualified Participant will be selected at random to win the entire jackpot value (the Mini Mystery winner).
• The winner of the Mini Mystery Jackpot shall be notified, as explained in the How Can I Win section above.
• Winnings (Bonus Dollars) can be redeemed and wagered per the How Can I Win section above and the Wagering Requirement section below.
• Moonlight Mystery Jackpot
• The Moonlight Mystery Jackpot can trigger once daily (except Fridays) by the “Must Go Before” time indicated on the Borgata Bucks promotional page.
• The jackpot value shall split into two (2) equal amounts and will be credited as set out below.
• Once triggered, one (1) Qualified Participant will be selected at random to win one half of the jackpot value (the Moonlight Mystery winner).
• The remaining half of the Moonlight Mystery jackpot value shall be split equally between the remaining Qualified Participants.
• The Moonlight Mystery winner and Qualified Participants shall be notified, as explained in the How Can I Win section above.
• Winnings (Bonus Dollars) can be redeemed and wagered per the How Can I Win section above and the Wagering Requirement section below.
• Summer Share Jackpot
• The Summer Share Jackpot can trigger once per week on a Friday by 10:00 pm (EST).
• Once triggered, all Qualified Participants shall be awarded an equal share of the Summer Share jackpot value.
• All Qualified Participants shall be notified, as explained in the How Can I Win section above.
• Winnings (Bonus Dollars) can be redeemed and wagered per the How Can I Win section above and the Wagering Requirement section below.

Wagering Requirement:

• The wagering requirement on all Bonus Dollars received from this promotion is 1x the Bonus Dollars amount. For every $1 in Bonus Dollars value, participants must wager $1. For example: If a participant receives $5 Bonus Dollars, the participant must wager $5 to cash out the bonus and any associated winnings.
• The participant has three (3) days following the Bonus Dollars activation to complete the wagering requirement after which time unused Bonus Dollars will be permanently forfeited and expire if not used.
• Play on all casino games at Borgata Online contributes toward the Bonus Dollars wagering requirement.
• Participants can opt-in to multiple bonuses at any given time. However, they can only contribute to the wagering requirements or release restrictions for one (1) bonus at a time. Wagering requirements and release restrictions apply to the first activated bonus, unless the participant pauses said bonus by resuming play on another bonus in the Bonus tab. Participants can resume using bonuses multiple times until they expire.
• Should the participant opt out of this bonus prior to completing the wagering requirement, the Bonus Dollars and winnings derived from the Bonus Dollars will be permanently forfeited and removed from the participant’s account.
• GAME CONTRIBUTIONS TOWARD BONUS WAGERING:
• The percentage of participant’s wager that counts toward participant’s wagering requirement varies based on the game participant is playing. Here are the percentages:
• Slots, Jackpot Slots, Scratch Cards, Fixed Odds Games, Virtual Games: 100%
• For Example: If I wager $125 on Scratch Games → I release up to $125, as they count 100%.
• Table, Roulette, Live Dealer (All Games), Video Poker, Baccarat, Craps: 20%
• For Example: If I wager $125 on Roulette → Only $25 is considered wagered, as Roulette counts 20%.
• Blackjack (Non-Live Dealer Only): 10%
• For Example: If I wager $125 on Blackjack → Only $12.50 is considered wagered, as Blackjack counts 10%.

Order of Funds Used for Wagering:

• After the participant’s account is credited with a Bonus Dollars and the participant starts a new game session, the Bonus Dollars will be used first to complete the wagering requirement. Upon completion of the wagering requirement, any winnings will be credited to the participant’s cash balance, and any subsequent wagers will be debited from the participant’s cash balance.

Withdrawal Restrictions:

• Bonus Dollars may not be cashed out and participant must complete the wagering requirement before any winnings associated with the Bonus Dollars may be cashed out.
• If a participant has an active Bonus Dollars, the participant’s next deposit funds may be restricted to the wagering contributions of the active Bonus Dollars. Bonus Dollars amounts are restricted and are not eligible for withdrawal until the wagering requirement of the Bonus Dollars is met. Participant can check their available funds for withdrawal through My Account > My Balance.
• A participant should review his or her account for any active bonus before making a deposit and placing wagers to avoid restrictions.
• Bonus Dollars can only be wagered via the Borgata Online website or mobile app and must be used within three (3) days following the participant’s award of the Bonus Dollars.
• Bonus Dollars cannot be redeemed or wagered on any other Borgata Online brands.
• Bonus Dollars do not count toward qualifying for any other promotional offers, unless otherwise specifically stated in the Terms and Conditions of such promotional offer.
• Any other restrictions in Borgata Online’s Terms of Service that are not inconsistent with the Terms and Conditions of this promotion shall also apply.

Important Terms:

• Sponsor will have complete discretion over interpretation of these Terms and Conditions and administration and operation of the promotion. Decisions of sponsor will be final and binding in all matters related to the promotion. Sponsor reserves the right to change or end any promotion for any reason, including, without limitation, if required for legal and regulatory reasons. 
• By entering and/or claiming this promotion, each participant agrees for participant and for participant’s heirs, executors, and administrators (a) to release and hold harmless sponsor, its parent and affiliate companies, and any advertising agency or web company connected with sponsor, and each of their respective officers, directors, and employees (collectively, Released Parties) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such participant’s participation in this promotion and/or his/her acceptance, possession, use, or misuse of the rewards(s) or any portion thereof (including any travel related thereto); (b) to defend and indemnify Released Parties from any and all claims or liability resulting or arising from this promotion and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the reward(s), including express warranties provided exclusively by reward provider that are sent along with the reward(s); (c) to the posting of such participant’s name on sponsor’s website and/or mobile application and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Terms and Conditions for this promotion and to waive any right to claim any ambiguity or error therein or in this promotion itself, and to be bound by all decisions of sponsor, which are binding and final. • Released Parties shall not be liable to any participant or any other person for failure to supply the reward or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action[s], regulations[s], order[s] or request[s] prove[s] to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, pandemic, public health emergency, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond sponsor’s sole control (Force Majeure Event). A Force Majeure Event expressly includes (i) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as COVID-19), or (ii) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.
• Released Parties are not responsible for and shall not be liable for:  (i) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in this promotion; (ii) technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a participant’s ability to take part in this promotion; (iii) unauthorized human intervention in any part of the entry process of this promotion; (iv) technical or human error which may occur in the administration of this promotion or the processing of entries; (v) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, undeliverable, damaged or stolen entries or notices (including winner notifications, if applicable); (vi) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (vii) any printing, typographical, human, administrative or technical errors or omissions in any material associated with this promotion; (viii) any injury, loss, costs, expenses or damages to persons or property (including, but not limited to, damage to any computer system or mobile device related to participation in, accessing or downloading information related to this promotion) which may be caused, directly or indirectly, in whole or in part, from participant’s participation in this promotion or any related activity; (ix) any illegal activity by participant or anyone acting in concert with participant; and/or (x) any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any persons.  
• The promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. 
• Sponsor reserves the right to alter, discontinue or terminate any promotion, or any aspect of it, at any time, with or without notice, for any reason whatsoever, including without limitation if there has been any printing, production, distribution or other error in any promotion communication or on the platform, or where there has been any error in the preparation for or conduct of any promotion affecting the result of the promotion or the number of participants or the value of claims. 
• Sponsor reserves the right to change or cancel this promotion in its entirety or exclude any individual or individuals from participation if it determines, at its sole discretion, that there are any irregularities or abuses occurring in connection with the promotion. 

• Upon request for cancellation, sponsor will inform the player of the amount of unrestricted funds that will be returned upon cancellation and the value of restricted funds that will be removed from the player’s interactive gaming account. If the player elects to proceed with cancellation, unrestricted funds remaining in a player’s interactive gaming account will be returned in accordance with the Terms and Conditions.

• All claims arising from or related to these Terms and Conditions and the promotion shall be resolved individually, without resort to any form of class action and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and, except as expressly provided in these Terms and Conditions, in no event include attorneys’ fees, and under no circumstances will any participant be permitted to obtain awards for, and participant waives all rights to claim, any punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and entrant waives all rights to have damages multiplied or otherwise increased.
